Anonymity for defendants

I think we need to have a serious look at the whole of the adverserial basis for the criminal trial. It has a major impact on the way the police operate. The police have no interest in looking for evidence that might support the accused, in fact they have a positive interest in making sure such evidence does not come to light. In an inquisitorial system the presiding judge at the inquiry stage can and does direct the police to look at evidence for the defence.

An adversarial system is fine if you have a level playing field and both sides have the same resources, unfortunately that is not true where the criminal law is concerned.
